Taiwan's Supreme Court Justices gave their verdict on marriage equality at 4 p.m. on 24 May 2017. The panel of 14 judges ruled that Taiwan's civil code which stated that marriage should be between a man and a woman was unconstitutional. The authorities concerned should amend or enact relevant laws, in accordance with the ruling of this Constitutional Interpretation, within two years from the issuance of this Interpretation. Taiwan is the first Asian nation to legalize gay marriage.

On 20 February 2019, a draft bill entitled the Act for Implementation of J.Y. Interpretation No. 748 was published. The draft bill would allow two persons of the same sex to create a "permanent union of intimate and exclusive nature for the committed purpose of managing a life together to fulfill the equal protection of the freedom of marriage" and grant them almost all the rights available to married heterosexual couples, with the notable exception of joint adoption and in vitro fertilization. The Executive Yuan passed it the following day, sending it to the Legislative Yuan for fast-tracked review. The bill was passed on 17 May, signed by President Tsai Ing-wen on 22 May and took effect on 24 May 2019 (the last day possible under the court ruling). Apart from very few cases approved by court, the Act does not cover joint non-genetic adoption.
